Scranton, Pennsylvania gets “Home Rule Law,” granted by the PA Commonwealth Court. Home Rule Law gives Scranton the right to collect taxes from residents that exceed the Local Tax Enabling Act (known as Act 511). The Home Rule Law provides that while the subjects of taxation may be limited by Act 511, the rates of taxation may not. Act 511 applies limits to home rule municipalities. The Court found that the PA Constitution allows a home rule municipality all powers that aren’t denied by the Constitution, the General Assembly or a home rule charter. Once Scranton elected home rule status, it retained the powers of Act 511 but not its limitations. Contact us with questions.
